Public Breastfeeding Law

1. A person, with intent to arouse, appeal to, or gratify that person’s lust, passions, or sexual
desires, is guilty of a class A misdemeanor if that person:

4. The act of a woman discreetly breastfeeding her child is not a violation of this section.
SECTION 2. Two new sections to chapter 23-12 of the North Dakota Century Code are created
and enacted as follows:
Right to breastfeed. If the woman acts in a discreet and modest manner, a woman may
breastfeed her child in any location, public or private, where the woman and child are otherwise
authorized to be.

    If there isn’t a workplace pumping law, that means the Federal law is applied, correct? I am having a few issues with my job and want to make sure I am covered. Also, if the company has a parent location in another state, which state laws do I look up? Thank you so much for this wonderful website. I found it through a link on

      Yes, federal law covers you regardless of state law. But be sure to check my section on federal law. Sadly, federal doesn’t offer much in the way of protection just yet.

      As for which state law applies, it is the law of the state in which you work, not the parent company.

    Does ND have a law about having to be covered while nursing?

      NO state has a law requiring having to cover while nursing.

          In truly public space (not a public accommodation like a restaurant), absolutely. However there is no enforcement provision in North Dakota if you are bothered nursing somewhere else.

    I have been nursing babies in ND for 2 1/2 years now. I have nursed at the mall, goodwill, restaurants, parks, zoo, grocery stores, and various parking lots. I have never had any problems or any looks either. I do always keep a cover on…just for my own privacy.
